1. General
These Terms govern the use of the Dachamatics application, the website https://dachamatics.org and related services (the “Service”).

These Terms constitute a public offer by the Operator (Article 437(2) of the Civil Code of the Russian Federation, the “Civil Code”).
The offer is accepted by registering an account and ticking the box confirming agreement with the Terms of Use and the Privacy Policy (Article 438(3) of the Civil Code). Upon acceptance the contract between the User and the Operator is concluded. The version of the accepted Terms and the time of acceptance are recorded.
The Consent to Personal Data Processing is a separate document and is given by a separate tick.
Application functions that do not require an account are used on these Terms from the moment the User starts using the application.
2. Service
Dachamatics is a digital garden-planning and management service providing, among other things:
- visual garden planning;
- plot and bed management;
- plant and variety records;
- planting and harvest planning;
- garden history;
- seed and storage records;
- pest and disease records;
- soil information;
- supported sensor data;
- weather information;
- reminders;
- predictive calculations and recommendations.
3. Account
Certain features require an account.
The User must provide accurate information and keep account credentials secure.
Registration uses an email address and password or Google Sign-In. On first sign-in with Google, the User accepts the Terms of Use, the Privacy Policy and the Consent to Personal Data Processing in the same manner as on registration.
Signing in with Google using an email address already registered with a password links Google Sign-In to the existing account; the password is removed and the account's sessions, device push tokens and reminder schedule are revoked.
4. Age
Dachamatics is intended for users aged 14 or older.
By registering, the User confirms having reached the age of 14 and being permitted to use the Service.
Transactions involving payment are concluded under separate terms by persons aged 18 or older.
The current registration flow does not technically collect age information.
Nothing in these Terms is intended to override mandatory rights of minors under applicable law.
5. Garden Data
Users may create and store information including:
- garden dimensions and coordinates;
- plots and beds;
- crops and varieties;
- planting and harvest dates;
- harvest volumes;
- pests and diseases;
- notes;
- soil tests;
- fertilizers and watering;
- seed and storage data;
- sensor measurements;
- other garden information.
The User is responsible for the accuracy of information entered into the Service.
Incorrect data may result in inaccurate calculations or recommendations.
7. Free Features
The Service includes free features.
The Operator may change, add or remove free features subject to applicable law.
8. Activation Codes
Access to paid features is granted free of charge by activation code or by an administrator of the Service. No fee is charged for access granted by activation code.
Access is granted for the term stated in the activation code or, where granted by an administrator, for the term set by the administrator. The term runs from the moment the code is redeemed.
An activation code may be redeemed once and by one account. A code cannot be exchanged for money.
When the term ends, access to paid features ends. Data entered by the User are retained.
9. Recommendations and Predictions
Dachamatics provides predictive and informational assistance.
Recommendations use:
- User-entered garden data;
- crops and varieties;
- planting dates;
- harvest information;
- soil information;
- sensor data;
- weather information;
- public databases;
- scientific literature;
- seasonal factors;
- algorithms and statistical models.
Recommendations are not guarantees.
10. Agricultural Disclaimer
Dachamatics does not guarantee:
- successful germination;
- successful growth;
- a particular harvest;
- a particular harvest volume;
- plant health;
- absence of disease or pests;
- accuracy of weather forecasts;
- accuracy of soil information;
- suitability of a recommendation to a specific plot;
- any other specific agricultural outcome.
The User makes the final decision about whether to act on a recommendation.
11. Pests and Diseases
Information concerning pests and diseases is informational and predictive.
Dachamatics does not guarantee that a pest or disease has been correctly identified or that a recommended measure will be effective.
For important plant-health decisions, the User should consider professional advice and actual inspection of the plant and growing conditions.
12. Fertilizers, Pesticides and Other Products
Information provided by Dachamatics about fertilizers, pesticides or other agricultural products is not a substitute for:
- manufacturer instructions;
- applicable law;
- product labels;
- official agricultural guidance;
- professional advice.
The User is solely responsible for checking whether a product may legally be used in their jurisdiction and for following all application, dosage, safety and waiting-period requirements.
A recommendation by Dachamatics is not in itself a permission to apply a product.
Information from the plant protection product registries of Germany (BVL) and France (ANSES) is provided for reference and gives no permission to apply the respective products in the Russian Federation. In the Russian Federation, pesticides and agrochemicals included in the State Catalogue of Pesticides and Agrochemicals Permitted for Use in the Russian Federation are applied (Federal Law No. 109-FZ of 19 July 1997 “On the Safe Handling of Pesticides and Agrochemicals”).
13. Weather and External Data
Weather, soil and other external data are supplied by third-party providers.
These sources may be incomplete, delayed or inaccurate.
Dachamatics does not guarantee that external information is accurate for the User's specific plot.
14. Sensors
Sensor readings may be incomplete, delayed or inaccurate.
Dachamatics does not guarantee uninterrupted sensor connectivity or continuous availability of sensor data.
15. Self-Built Hardware
The sensor hub and sensors working with Dachamatics are built by the User following instructions published on the website https://dachamatics.org. The Operator is not the manufacturer or seller of such hardware.
The User is responsible for compliance with electrical safety requirements when assembling, powering and operating the hardware.
The User is responsible for compliance with the radio-frequency spectrum rules in force at the place of operation, including permitted frequency bands and transmission power.
16. Notifications and Calendar
The User may receive reminders through push notifications, calendar events or supported widgets.
Delivery depends on the device, operating system, network and third-party services.
The User remains responsible for important actions even where a reminder has been configured.
17. Intellectual Property
The software, interface, algorithms, visual design, databases, documentation, branding and other protected elements of Dachamatics are owned by the Operator or relevant rights holders.
The User receives only a limited right to use the Service as intended.
Reference data of the Service — information on crops, varieties, pests, plant protection products, phenological observations and photographs — are obtained from open sources and distributed under the licences of those sources. The sources and licences are listed on the “Data sources” screen of the application and on the website. The restrictions of these Terms do not apply to such data.
18. User Data
The User retains their rights in their User Data.
The User grants Dachamatics the limited rights necessary to:
- store data;
- synchronize data;
- provide sharing;
- generate calculations and recommendations;
- maintain backups;
- protect the Service.
The processing of personal data is governed by the Privacy Policy.
19. Prohibited Use
Users must not:
- use the Service unlawfully;
- circumvent paid-access mechanisms;
- interfere with the Service;
- attempt unauthorized access;
- exploit security vulnerabilities;
- scrape substantial portions of the Service without authorization;
- use the Service to infringe third-party rights;
- distribute malware;
- abuse sharing mechanisms.
The prohibition on circumventing paid-access mechanisms does not extend to the User modifying the software of their own hardware, including the sensor hub.
20. Availability
The Operator does not guarantee uninterrupted or error-free availability.
The Service may be temporarily unavailable because of:
- maintenance;
- infrastructure failures;
- third-party service failures;
- security incidents;
- network outages;
- force majeure;
- other technical or operational circumstances.
The application remains functional without a network connection.
21. Changes to the Service
The Operator may change algorithms, interfaces, free features, paid features, data sources and integrations.
Changes affecting access already granted by activation code are made in accordance with applicable law.
22. Suspension and Termination
Access may be suspended or terminated where reasonably necessary because of:
- material violation of these Terms;
- fraud or abuse;
- security risks;
- unlawful use;
- legal requirements.
The User may stop using the Service at any time and delete the account independently in the application.
23. Account Deletion and Shared Data
The owner of a shared garden cannot delete the account while the shared garden has members; before deletion the owner ends the members' access.
After account deletion, information remains where:
- it belongs to another User's shared garden;
- it forms part of security or audit records;
- it is contained in backups;
- it is required to preserve another User's records.
The composition and retention periods of such information are set out in the Privacy Policy.
24. Liability
Information, calculations, predictions and recommendations provided by Dachamatics are informational.
The User makes decisions on planting and harvest timing, watering, fertilizer application, pesticide use and other actions on the plot independently and is responsible for their consequences.
The Operator's liability is determined by the legislation of the Russian Federation.
25. Consumer Rights
Nothing in these Terms is intended to exclude or limit consumer rights under Law of the Russian Federation No. 2300-1 of 7 February 1992 “On Protection of Consumer Rights”.
Terms that infringe consumer rights compared with the rules established by law do not apply (Article 16 of that Law).
26. Third-Party Services
Dachamatics relies on external services: Open-Meteo, ISRIC SoilGrids, Wikimedia Commons, Google Firebase Cloud Messaging, Google Sign-In.
The availability and processing of such services are governed by the respective providers' terms.
27. Force Majeure
The Operator is released from liability for non-performance caused by force majeure (Article 401(3) of the Civil Code).
28. Privacy
Personal data are processed in accordance with the Dachamatics Privacy Policy. Personal data are transferred to recipients outside the Russian Federation on the basis of the Consent to Personal Data Processing.
29. Changes to These Terms
The Operator updates these Terms as the Service and its legal or technical requirements change.
Each version of the Terms has the designation shown in the document header.
The User is notified of a new version and asked to accept it the next time the application writes data to the server. The new version takes effect for the User after notification and acceptance. Working offline and reading the User's own data are not restricted before acceptance.
A User who does not accept the new version may stop using the Service and delete the account.
30. Governing Law and Disputes
These Terms are governed by the legislation of the Russian Federation.
A claim is sent to the Operator at support@dachamatics.org. The Operator considers the claim and responds within 30 calendar days of its receipt.
Disputes are resolved in court in accordance with the legislation of the Russian Federation. A consumer may bring an action at the consumer's place of residence or stay, or at the place where the contract was concluded or performed (Article 17(2) of the Law of the Russian Federation “On Protection of Consumer Rights”).
The Terms of Use, the Privacy Policy and the Consent to Personal Data Processing are drawn up in Russian and English. In the event of any discrepancy, the Russian text prevails.
